New Delhi: The Indian Penal Code, 1860, Code of Civil Procedure, 1908, Criminal Procedure Code, 1973, Representation Of People Act, 1950, Census Act 1948 and Prevention Of Corruption Act, 1988, are among the laws which will be applicable to Jammu and Kashmir following Union Cabinet’s decision on Wednesday to approve adaptation of central laws under concurrent list to the Union Territory. The cabinet had approved the order for adaptation of Central Acts in the Union Territory under Section 96 of the Jammu and Kashmir Reorganisation Act, 2019. As a result, 37 central laws which were not applicable to the union territory will now be applicable.
According to Home Ministry, 37 central Acts that will be applicable to Jammu and Kashmir also include Income-Tax Act, 1961, Protection Of Human Rights Act, 1993, Official Languages Act, 1963, Press Council Act, 1978, Press and Registration Of Books Act, 1867, Insolvency And Bankruptcy Code, 2016, Census Act, 1948, Public Debt Act, 1944, Indian Forest Act, 1927 and All India Services Act, 1951.
The Arbitration And Conciliation Act, 1996, Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation And Resettlement Act, 2013, Limitation Act, 1963, the Court-Fees Act, 1870, Textiles Committee Act, 1963, Securitization And Reconstruction Of Financial Assets And Enforcement Of Security Interest Act, 2002, Railway Property (Unlawful Possession) Act, 1966 and National Co-Operative Development Corporation Act, 1962 will also be applicable to the union territory.
The release said it is necessary to adapt central laws made under the concurrent list, with required modifications and amendments, for ensuring administrative effectiveness and smooth transition with respect to Jammu and Kashmir to remove any ambiguity in their application.
According to Section 96 of the Jammu and Kashmir Reorganisation Act, 2019, the Central Government has requisite powers to make adaptations and modifications of the laws whether by way of repeal or amendment.

SRINAGAR – “People should not mistake flu illness with coronavirus as both have similar symptoms which is fever and cough,” said Doctors Association Kashmir (DAK) on Saturday in a communiqué.
“Every fever and cough is not coronavirus,” said DAK President Dr Nisar ul Hassan.
“A suspect case of new coronavirus is one who has respiratory symptoms and has a history of travel to the affected area in the past 14 days or the one who has been in close contact with a confirmed case of coronavirus infection within the last 14 days,” he said.
Dr Nisar said despite similar symptoms of coronavirus to flu, there are some important differences.
Quoting a study published in The Lancet, he said coronavirus cases do not exhibit upper respiratory tract symptoms like runny nose,sore throat and sneezing which are seen in most of flu cases.
Dr Nisar said the new coronavirus,like flu spreads mostly from person to person by respiratory droplets, but new research suggests coronavirus can also spread through feces and this could be the reason for the rapid spread of the virus.
“While this year’s flu virus is hitting kids especially hard, coronavirus has largely spared this vulnerable group,” he added.
“Coronavirus, also called COVID-19 is a novel (new) virus that originated in Wuhan city of China has killed 2,362 people and infected 77,925 people so far.
Men represent the majority of novel coronavirus cases, and they seem to die more often from this deadly infection.
Research has found that the death rate among men was 2.8% compared to 1.7% among women.
Majority of the patients who died of novel coronavirus were older men with underlying health problems like diabetes, hypertension and heart disease,” said Dr Nisar.
“Despite life-saving benefits of flu vaccine in pregnancy, majority of expectant mothers are unvaccinated,”
Doctors do not offer flu vaccine to expectant mothers putting them and their babies at risk
Srinagar Feb 20: “Most of the pregnant women in Kashmir valley are not getting vaccinated against flu,” said Doctors Association Kashmir (DAK) on Thursday in a communiqué. “Despite life-saving benefits of flu vaccine in pregnancy, majority of expectant mothers are unvaccinated,” said DAK President and flu expert Dr Nisar ul Hassan. “The reason why pregnant women are unvaccinated is because they are unawareabout the importance of flu vaccine,” he said. “Also, doctors do not offer flu vaccine to expectant mothers putting them and their babies at risk,” he added. Dr Nisar said pregnant women are prone to develop severe illness from flu, which can lead to hospitalization, and even death. Quoting a study, he said flu vaccine reduces pregnant women’s risk of hospitalization by 40%. “The vaccine in pregnancy saves infants from dying in the womb,” Dr Nisar said adding “a large study has shown that flu vaccine reduces the risk ofstillbirths by 51%.” He said there is evidence to suggest that a pregnant woman sick with flu has a greater risk of preterm delivery and that a flu vaccine lessens that risk. Dr Nisar said mother’s flu shot protects her baby up to 6 months after he or she is born, which is important because babies younger than 6 months of age cannot be vaccinated. “In a paper published in journal Pediatrics it was found that infants born to women vaccinated for the flu were 81% less likely to be hospitalized during their first 6 months of life,” he said. “Flu vaccine is perfectly safe for pregnant women and can be given to pregnant women during any stage of pregnancy.The power of vaccination in pregnancy is a message that should be broadcast far and wide. It is imperative that obstetricians should advocate for flu vaccination and provide flu vaccine to expecting mothers,” said Dr Nisar.
Jammu: PDP Member parliament Muzafar Hussain Beigh today demanded restoration of Statehood of Jammu and Kashmir.
He said this during a function organised by Pahari welfare culture forum in Jammu in his honour for bagging Padma Bhushan award recently.
“I hope that statehood of J&K is restored very soon,” Beigh told gathering during his speech.
He said India and Pakistan leadership has to play their role for lasting peace in south Asia particularly in J&K. However he blamed Pakistan for doing mischief and thwarting peace efforts of India.
“ PM Modi went to Pakistan even without invitation. Then they paid back with Pathankot, similarly, after Agra summit, they did Kargil,” he said.
Without naming anyone, he blamed some political leaders for bloodshed in Kashmir.
He also praised dogra rulers for securing the rights of the state and its subjects.
Taking a leaf from history, he said that British divided Hindu-Muslims in 1858.
“When Ali Muhammad Jinnah left congress, he went to London. British government there asked him to seek separate land for Muslims,” he said in a statement issued to KNS.
“If India would have been undivided. It would have been most powerful voice in United nations,” he said.

The Jammu and Kashmir police on Monday lodged a First Information Report against locals for using social media platforms on virtual private networks (VPNs).

“Taking a serious note of the misuse of social media, the Cyber Police Station, Kashmir Zone, Srinagar, has registered an FIR against various social media users, who defied the government orders and misused the social media platforms,” a Srinagar-based police spokesman said on Monday.

The police said there were continuous reports of misuse of social media sites by miscreants “to propagate the secessionist ideology and to promote unlawful activities”.
The FIR has been registered while taking cognisance of the social media posts by miscreants by using different VPNs, which are propagating rumours with regard to the current security scenario in the Kashmir valley, secessionist ideology and glorifying terrorists, the police said.

“A lot of incriminating material has also been seized in this regard,” the spokesman said.
The case is registered under FIR No. 01 of 2020 U/S 13 U A (P) Act, 188, 505 of IPC and 66-A(b) of the IT Act.
“I appeal to the general public not to use social media via VPNs,” Inspector General of Police Vijay Kumar said.
The J&K government had on January 14 banned all social media sites. The ban, the government said, was to curb the misuse of sites by miscreants for propagating false information “having the effect of causing social instability”.

West Bengal Chief Minister Mamata Banerjee on Wednesday alleged that nationalised banks and post offices were being “used” by the Centre in her state to collect data in order to “manipulate” the CAA-NRC-NPR.
Banerjee made the accusation while addressing an administrative meeting here, and said such survey by central government undertakings must “stop immediately”, without elaborating where and when such an exercise happened,officials said.
Banerjee said surveys are being done without the state government’s permission.
“The banks and post offices are doing this without taking the name of BJP…they are visiting houses to conduct the survey. They cannot do this without the state government’s permission… do not give any information to anyone.
“We will not allow this. We have to strongly handle this,” she told top state officials at the meeting.
She also cited the incident of a group of BJP workers visiting a jewellery shop in Habra in North 24 Parganas district and asking for documents allegedly connected to the CAA and NRC, and asked people to drive away any such people.
“Today, I saw news on television that a group of around 15 BJP people went to a jewellery shop in Habra and demanded that they show papers required for CAA and NRC. Who has given them the authority to do this?
“Just drive away such people….don’t believe if they tell you they are from the government,” she said.
Meanwhile, an FIR has been registered with Habra police station in connection with the alleged incident.

The district administration in Sambhal has issued notices to 11 persons, participating in anti-CAA protests, asking them to sign a personal bond of ₹50 lakh each with an undertaking that they would not indulge in any disruptive activities.
The notices have been sent under Section 111 of CrPC (magistrate order against any person who is likely to commit a breach of peace) on the basis of a police report.
Nakhasa Sub-Divisional Magistrate Rajesh Kumar said: “The 11 persons have been told in the notices that police suspect that they may get involved in violence and therefore a personal bond of Rs 50 lakh and two sureties for the same amount should be taken from each of them.”
He added that the notices would be sent to 24 other people soon.
According to the police, around 500 women are staging a protest round-the-clock at a farm near Hussaina Bagh in Nakhasa police station area since last month.
Station House Officer (SHO) Nakhasa police station, Devendra Singh Dhama said that the police have also registered an FIR against unidentified persons under IPC sections 188 (Disobedience to order duly promulgated by public servant) and 505 (statement conducing public mischief) but no arrests have been made in the case yet.
Dhama added that a few days ago, a report mentioning names of 36 people was sent to the district administration, requesting that these persons should be told to sign a bond to ensure that peace would be maintained under section 107/116 of CrPC.
“Among these are women protesters and men helping them. We prepared a list on the basis of a preliminary inquiry,” said Dhama.
Two persons died and several were injured in a protest against the new citizenship law in Sambhal on December 19 and 20 last year. As many as 12 FIRs were registered in connection with the violence and 43 people were arrested. Some of the accused have been released on bail.
Earlier, on Monday, the Aligarh administration forfeited the security of Rs 1 lakh each of four students of Aligarh Muslim University who had earlier signed similar bonds.

The BJP tried its best but “could not convince people” of the national capital, the cricketer-turned politician, who won his debut election from east Delhi last year, said and congratulated Mr Kejriwal.

“We tried our best but, probably, we could not convince the people of the state. I hope Delhi develops under the chief ministership of Arvind Kejriwal,” Mr Gambhir said.
The remark by Mr Gambhir – who had defeated AAP’s Atishi Marlena last year in Lok Sabha elections in east Delhi – came hours after Delhi BJP chief Manoj Tiwari had said that his party would come to power after winning “up to 55 seats” in the 70-member assembly.
“We will win 48-plus seats. I will not be surprised even if we win 55,” Manoj Tiwari told reporters this morning, rejecting exit poll predictions of AAP winning a third straight term. The BJP was believed to have banked on a last-minute surge in voting, which, the party felt, would have worked in its favour.
As counting of votes proceeded and the AAP headed for a two-thirds majority, Mr Tiwari later urged his party workers to “not be disheartened”.

BJP leader Parvesh Varma, pulled for delivering hate speeches during poll campaign, also conceded defeat. “I accept the result. We will work hard and give a better performance in the next elections,” he told ANI.
Delhi saw a bitter election campaign revolving around the Shaheen Bagh protest against the citizenship law as the BJP tried to make a comeback in the national capital after two decades and the AAP sought a third consecutive term.
