  • HC declines to entertain Omar’s plea for early hearing in divorce case

    PTI

New Delhi: The Delhi High Court Thursday declined to entertain former Jammu and Kashmir Chief Minister Omar Abdullah”s plea seeking early hearing of his appeal against a 2016 trial court order, which dismissed his divorce petition, saying his estranged wife”s consent was also required for advancing the date.

A bench of Justices Hima Kohli and Subramonium Prasad said the high court”s Registrar General has already issued a circular stating that during the restricted functioning of courts due to COVID-19, a request for final hearing of pending matters will be entertained only if both the parties agree.

“In view of the fact that this application is not accompanied by any consent from the other side (Payal Abdullah) and nor is the counsel for the respondent present in the hearing, though we are informed that an advance copy of the application was served on him, we are not in a position to accede to the prayer made in the application,” the bench said.

“The application is dismissed,” it added.

Omar”s lawyer told the court that the “lack of cooperation” from the other side was the reason for filing the application.

On August 30, 2016, the trial court had dismissed Omar”s plea seeking divorce from Payal saying he had failed to prove irretrievable breakdown of the marriage.

The trial court had said that Omar could not prove his claims of “cruelty” or “desertion” which were the grounds alleged by him for grant of decree of divorce.

“The petitioner (Omar) has not been able to explain a single circumstance to show that the supervening circumstances have erupted which has made it impossible for him to continue his relationship with the respondent (Payal).

“Rather, evidence shows that they were in continuous contact till the filing of the divorce petition,” the court had said in its order, adding that “there is not an iota of evidence in regard to the circumstances which have prevailed to prompt the petitioner to file the divorce plea”.

It had further held that Omar “failed to prove his case for divorce on ground of cruelty”.

In his plea seeking divorce, Omar had claimed before the trial court that his marriage had broken down irretrievably and he has not enjoyed a conjugal relationship since 2007 and that the couple, married on September 1, 1994, were living separately since 2009. The couple have two sons who are staying with their mother.

The petition before the trial court had also alleged that Omar was subject to “unreasonable conduct” of Payal, causing pain and harassment to the politician. PTI

  • JK Admin recovers Rs 39.69 lakh from senior IAS officer he acquired illegally: Sources

    PTI

Srinagar: The Jammu and Kashmir administration has recovered Rs 39.69 lakh from a senior IAS officer he allegedly took from an organisation and recommended a probe into his alleged illegal monetary benefits, sources said on Thursday.

The Lt Governor administration put a notice to the senior IAS officer for allegedly getting illegal monetary benefits from the organisation and asked him to remit the amount worth several lakhs to it, they said.

The officer remitted an amount of Rs 39,69,359 back to the organisation recently, the sources said.

The officer further submitted that Rs 20,86,120 has been deducted as TDS and deposited with the Income Tax department, they added.

A senior officer of the administration has recommended a probe against the IAS officer as per the government rules before imposing any penalty, the sources said.

He has also recommended issuance of warning letter to the officer and closure of the case without informing the matter to the Department of Personnel and Training (DoPT), they said

However, Lieutenant Governor G C Murmu has refused to close the case before a probe by the DoPT, the sources said.

The Lt Governor administration has taken a serious note for hiding the issue from the DoPT and instructed for ordering a probe into it.

Earlier in June, the administration had written to the DoPT to take action against an IAS officer who allegedly tried to prevent the Amarnath Shrine Board officials from undertaking “pratham pooja” (first prayer) for Amarnath yatra.

This was for the first time in many years that the J and K administration has made a complaint to the DoPT against a bureaucrat, sources had said then.

The sources said that the J and K administration is yet to receive any formal reply on action taken by the DoPT over the issue.

  • Four BJP leaders, workers resigned in 6 days in North Kashmir

Srinagar: All is not well in the BJP as four leaders and workers have resigned from the party in north Kashmir for the last six days.

This comes after a BJP youth leader along with his father and brother were killed in Bandipora.
A social activist from Handwara, Mubeena Bano, who had joined BJP a few months before, Thursday resigned from the party.

“I have been working to redress issues of people since 2015. I had joined BJP to resolve the issues of people. But nothing is being done on the ground so I resigned from the BJP,” she told news agency Kashmir Indepth News Service (KINS).

Similarly, Bashir Ahmad Malik son of Mohammad Subhan Malik of Thokerpora Handwara who was part of the BJP also announced his resignation from the party on Thursday.

On Saturday, Bharatiya Janata Yuva Morcha (BJYM) president from Baramulla, Marouf Bhat tendered his resignation from the party.

  • JK government busy in photo-Ops and PR; totally failed to contain COVID-19: Akbar Lone

Srinagar: Jammu and Kashmir National Conference on Thursday expressed concern over the snow balling of COVID-19 into mammoth crises, saying the administration has turned its back on the exigencies that have cropped up in wake of the increased number of infections and mortality.

In a statement to Kashmir Today, National conference senior leader and Member of Parliament from Baramulla Muhammad Akbar Lone said the increasing rate of mortality and COVID-19 contamination reveals the failure of the present regime to deal with the crises. “Had the ruling regime in J&K come up with a well thought out strategy to cope up with the prevailing crises, the situation would not have become as dire as it is now.

We see how in a well-organized manner various state governments across the country made ample arrangements in form of creating makeshift hospitals, extra testing facilities, availability of ventilators to cope up with the viral sprawl.

Unfortunately big shots in the administration kept themselves confined to Jammu up until June, leaving the people in the valley to fend for themselves. Regrettably the administration also failed to scale up the existing infrastructure in hospitals by augmenting existing bed strength and other life saving equipment,” he said.

Expressing dismay over the scarcity of beds in hospitals, Lone said, “There aren’t enough beds in hospitals; everybody cannot afford to admit his kith and kin in private nursing homes. With the number of cases rising every day, the strain on the health care infrastructure in J&K, especially Kashmir has begun to show up.

Attendants, patients are now coming out equivocally and expressing their anger about not being able to find hospital beds, proper treatment for themselves, their family and friends. Hospitals are also short of human resources to deal with the increasing rush. Non-Covid patients are not being segregated from the infected.

The macro and micro management of incoming rush and COVID-19 protocol in hospitals has gone for a toss. No measures are being taken to manage the over load in tertiary and secondary hospitals; improving testing and documentation; diagnosis and care without risking the safety of patients and healthcare.”

“Administration is selling failed lockdown as a success, the idea behind the lockdown was to flatten the curve of COVID-19 infection, and the administration has failed to achieve that end. It is needless to say that the present regime in J&k has failed to follow the “trace, test and treat” norm of the world health organization.

It seems that the administration has given in; it is only busy in photo-ops and PR.

The response of the JK administration to COVID-19 crises presents a grimy tale of shortfalls and mistakes. The what-aboutery of the civil administration is only adding to the miseries of people,” he said.

He further added, “Far from utilizing the previous lockdowns to curb the viral spread, the government is using it as a cover to hide its failures on all fronts.

The negligence of the administration has given rise to new COVID-19 clusters by pushing people to queue up for domicile forms, class 4th jobs ignoring the COVID-19 protocol.

The primary duty of the administration is to serve people; unfortunately in this part of the world it is the other way round. It goes without saying that presently J&K typifies a dysfunctional anarchy.

Administration has incontestably failed common people, the frontlines workers, the medics and ground staffers in their hour of need. It has failed on every conceivable matrix in its response to the prevailing crises.”

  • LAC issue: Disengagement process on border intricate and requires constant verification, says Army

India and China committed to complete disengagement, says a statement

The disengagement process on the border to resolve the tensions is “intricate and requires constant verification” and both India and China remain committed to the objective of complete disengagement, the Army said on Thursday.

A convoy of Indian Army trucks move towards the Line of Actual Control (LAC) in eastern Ladakh, in the backdrop of the current stand-off with Chinese troops, in Leh on July 4, 2020.

“The Senior Commanders reviewed the progress on implementation of the first phase of disengagement and discussed further steps to ensure complete disengagement,” the Army said in a statement on the talks at the Corps-Commander level held on Tuesday. The engagement was consistent with the consensus reached between the Special Representatives of India and China on July 5 to discuss complete disengagement, it stated.

The fourth round of senior commander-level talks on Tuesday at Chushul went on for 15 hours during which the two sides worked out details for the next phase of disengagement as well as complete withdrawal of forces along the Line of Actual Control (LAC).

India and China have been engaged in discussions through established military and diplomatic channels to address the prevailing situation along the LAC since the standoff began in early May.

An Army source described the talks on Tuesday as “positive”. Stating that there had been full disengagement from Patrolling Points 14 and 15, partial disengagement at Hot Springs and Pangong Tso, the source said, “Balance disengagement is expected in coming days.”

Following the talks on July 14, the high-powered China Study Group headed by the National Security Adviser deliberated on the progress of the talks on Wednesday.
